My name is Mark Connell and I’m an Elder Law Attorney serving clients along the shoreline and throughout Connecticut. This section of my website is titled, “In Crisis”.
By “in crisis” I mean that we have someone who is imminently about to go into a nursing home or is already in a nursing home. And, we are now going through the spend-down process to get them eligible for Medicaid assistance to pay for long term care costs.
Now, very often people have not established powers of attorney and Advance Health Care Directives beforehand. In those situations, we have to go to probate court and have someone appointed as their Conservator to handle their affairs.
Once the spend-down process is complete we have to pursue a Medicaid Application which today is a very complicated matter. I often have people who will try to do it on their own and they eventually come back to me because they need help.
In addition to the spend-down process, there are also some other more sophisticated strategies that I’m able to implement to help people preserve their quality of life.
For instance, we very often are able to make transfers to a caregiver child…we’re able to make transfers to children through a personal services contract…we can preserve assets for the spouse who’s left in the community with a Medicaid Compliant Immediate Annuity…and there are also Veterans Benefits called Aid and Attendance that can very often help pay for the cost of care.
When people come into my office, I go through a very thorough analysis of income and assets so that we could determine, based on their goals, exactly what the best plan of action would be for them.
